DESIGN AGREEMENT
Effective Date: 3/16/2026
This Design Agreement governs the design services provided by Sylvia Design LLC, doing business as Sylvia Outdoor Design ("Designer").
By approving a quote, submitting payment, or engaging services, the client ("Client") agrees to the following terms.
Scope of Services
Designer provides professional 2D landscape plans and 3D renderings intended to help visualize outdoor projects prior to construction.
Designs are conceptual illustrations and are not construction drawings, architectural plans, or engineering documents.
Client Responsibilities
The Client is responsible for providing accurate project information including:
• measurements
• site photos
• design preferences
• material selections
Designer is not responsible for inaccuracies resulting from incorrect or incomplete information provided by the Client.
Conceptual Nature of Renderings
Renderings are artistic representations intended to illustrate a proposed design concept.
Actual construction results may vary based on:
• materials used
• contractor installation
• site conditions
• grading and drainage
• structural requirements
Contractors are responsible for verifying all measurements and installation requirements.
Revisions
Each design project includes up to two (2) rounds of revisions unless otherwise specified.
Additional revisions may require additional design fees.
Turnaround Time
Estimated timelines will be communicated at the start of the project.
Delivery times may vary depending on:
• project complexity
• revision requests
• design queue
Payment Terms
Payment terms will be communicated prior to beginning work.
Projects may require:
• full payment in advance, or
• a deposit before work begins
Final deliverables may be withheld until payment is received in full.
Refund Policy
Due to the custom nature of design services, payments are non-refundable once work has begun.
Intellectual Property
All designs, plans, and renderings remain the intellectual property of Sylvia Design LLC until full payment is received.
Upon payment, the Client receives a non-exclusive license to use the designs for project presentation and marketing related to the specific project.
Designs may not be resold, redistributed, or used for unrelated projects without written permission.
Portfolio and Marketing Use
Designer reserves the right to display, reproduce, and publish completed design work, including 2D plans, renderings, and related project visuals, for marketing and promotional purposes.
This includes use on:
• the Designer’s website
• social media platforms
• marketing materials
• digital portfolios
• advertising and promotional content
The Designer agrees not to disclose confidential client information such as project budgets, private client details, or specific property addresses without permission.
Limitation of Liability
Sylvia Design LLC shall not be held liable for:
• construction outcomes
• installation errors
• contractor interpretation of designs
• structural or engineering issues
Contractors are responsible for confirming measurements and ensuring designs comply with local building codes.
Project Cancellation
If a project is cancelled after work has begun, payment for completed work remains due.
Acceptance of Agreement
By approving a quote, submitting payment, or engaging design services, the Client acknowledges and agrees to the terms of this Design Agreement.
